Madhubala’s Legal Fight for Justice
In 1996, Madhubala was given a flat in her late husband’s name. However, after his death, she had to wait many years to finally get possession of the flat.
When she received it in 2019, the flat was in terrible condition, with shabby walls and poor construction.
She used her savings to repair the flat but suffered a huge financial loss. In 2020, she filed a complaint with the District Consumer Commission, asking for compensation of Rs 20 lakh.
The Legal Battle and Hope for Homebuyers
Her complaint was initially rejected by the District Consumer Commission, which said that she was no longer considered a consumer after receiving the flat.
However, Madhubala didn’t give up. She appealed the decision to the State Consumer Commission.
The State Consumer Commission, led by chairperson Justice Sangeeta Dhingra Sehgal, ruled that anyone can seek compensation for poor service, even after taking possession of a property.
The commission emphasized that builders are responsible for delivering quality service to consumers. If the property is in poor condition, the builder must compensate the buyer.
A Strong Message for Builders and Buyers
The State Commission’s decision overruled the District Commission’s ruling and sent the case back for further review. Madhubala’s fight and the State Commission’s decision send a strong message to both builders and buyers.
Builders will now understand their responsibilities better, and buyers can feel more confident that they have legal recourse in case of poor service.
